Terms of Service
1. Definitions
"SwiftHost", "we", "us" means the trading name under which these services are supplied, operating through swifthost.io.
"Client", "you" means the person or entity that registers an account or orders a service.
"Services" means virtual private servers, dedicated servers, shared hosting, SSL certificates, and any other product supplied by us.
"Infrastructure Provider" means the third-party datacenter operators and hardware suppliers through whom the underlying capacity is sourced.
2. Nature of the service
SwiftHost supplies infrastructure capacity sourced from third-party datacenter operators. We are a reseller. The physical hardware, network, power, and facility are operated by the Infrastructure Provider, and the availability, performance, and continuity of any service depend on that provider.
SwiftHost is the trading name used to supply hosting and cloud infrastructure services, operating since 2026. Infrastructure, network, hardware, and datacenter operations are provided by external infrastructure partners.
For service matters, write to support@swifthost.io. To report abuse of our network, write to admin@swifthost.io. Both reach a person, at any hour.
All services are supplied unmanaged unless a written agreement states otherwise. You are solely responsible for the operating system, all software, all configuration, all security hardening, and all data on your service. We do not administer, monitor, patch, secure, or back up the contents of your service.
3. Account and eligibility
- You must be at least 18 years old and legally capable of entering into a binding contract.
- All information you supply must be accurate, current, and complete. We may suspend or terminate any account containing false, incomplete, or unverifiable information.
- You are responsible for all activity conducted through your account, including activity by any person you permit to access it.
- You must keep your credentials confidential and notify us immediately of any unauthorised access.
- We may require identity verification at any time and may refuse or withdraw service where verification is not satisfactorily completed.
- We reserve the right to refuse service to any person for any lawful reason, without obligation to state that reason.
4. Orders, delivery, and provisioning
An order becomes binding when payment is received and confirmed in full. Once payment is confirmed, every service is set up and checked before handover. Provisioning depends on hardware availability at our infrastructure provider, and no delay gives rise to any claim, credit, or refund.
We may cancel or refuse any order before delivery, in which case the amount paid for that order is returned and no further liability arises.
You accept that delivery depends on the availability of stock at the Infrastructure Provider and that stock is not guaranteed at any price.
5. Fees, billing, and renewal
- All prices are stated in United States dollars and are exclusive of any tax, duty, levy, or bank charge that may apply in your jurisdiction. Any such amount is your sole responsibility.
- Services are billed in advance for the full term selected. Invoices are issued in advance of the due date and must be paid in full by that date.
- Services renew automatically for the same term unless cancelled before the renewal date through your client area.
- Failure to pay by the due date may result in suspension. Continued non-payment results in termination and permanent deletion of all data, as described in section 8.
- We may revise pricing at any time. Revised pricing applies to renewals following notice; the current term is unaffected.
- Payments made in cryptocurrency are final on network confirmation. We are not responsible for any loss arising from an incorrect address, wrong network, insufficient confirmations, or exchange-rate movement.
6. Refunds and account credit
No payment is refundable in cash. This applies without limitation to services suspended or terminated for breach of these Terms, services rendered in full, setup or configuration fees, and any amount paid in cryptocurrency.
One exception, and it matters. Where we cannot deliver a service you have paid for, the full amount is returned to your account as credit, usable against any service we offer. If you would rather have the money back instead, tell us and we will arrange it. You are not left holding credit for something we never provided.
This policy exists because the underlying capacity is purchased from the Infrastructure Provider on your behalf at the moment of order.
Account credit on early cancellation
Where you cancel an active service before the end of its paid term, we may apply the value of the unused whole days to your account as credit. Each request is considered on its own facts, and what we can offer depends on what the Infrastructure Provider allows at that time.
- Credit is calculated on whole unused days remaining at the moment the service is stopped, less any discount already applied to the original term.
- Credit is usable only toward services supplied by us. It is not redeemable for cash, not transferable, and holds no monetary value outside your account.
- Credit is not issued where a service is suspended or terminated for breach of section 7, for non-payment, or on the direction of any authority.
- Credit expires twelve (12) months after issue if unused.
- Any decision under this section is final and creates no precedent or obligation in respect of any future cancellation.
7. Acceptable use
You must not use any service, or permit any service to be used, for any of the following:
- Any activity unlawful in the jurisdiction where the service is hosted, in the jurisdiction of the service provider, or in your own.
- Distribution or storage of child sexual abuse material. This results in immediate termination without notice, permanent ban, and reporting to the relevant authorities.
- Unsolicited bulk email, spam, or any activity that causes our address space to be listed on a blocklist.
- Distribution of malware, ransomware, viruses, exploit kits, phishing pages, or fraudulent content of any kind.
- Unauthorised access, port scanning, penetration testing, brute-force attempts, or any attack against systems you do not own.
- Participation in, or provision of infrastructure for, denial-of-service attacks, botnets, or command-and-control operations.
- Cryptocurrency mining, staking, validation, or any comparable compute-intensive workload, on any service. Our infrastructure partners prohibit this outright.
- Public or open proxy, VPN, or anonymisation services offered to third parties. A private VPN for your own use is permitted.
- Tor relays, exit nodes, bridges, or any Tor infrastructure.
- Torrent trackers, seedboxes, file-indexing services, or any peer-to-peer distribution platform.
- Adult or sexually explicit material of any kind.
- Gambling, betting, high-yield investment schemes, or any comparable financial scheme.
- Any activity that consumes resources disproportionately on a shared platform.
- Infringement of copyright, trademark, or any other intellectual property right.
- Content that incites violence, terrorism, or hatred against any group.
- Any activity that threatens the stability, security, or reputation of our network or that of the Infrastructure Provider.
We assess whether these terms have been breached, acting reasonably and on the facts available to us. If you believe we have got it wrong, tell us and we will look again.
8. Suspension and termination
We may suspend or terminate any service immediately and without notice where we reasonably consider that:
- a breach of section 7 has occurred or is occurring;
- payment is overdue;
- the service threatens the network, other clients, or the Infrastructure Provider;
- we are directed to do so by the Infrastructure Provider, a court, or a competent authority;
- continued provision would expose us to legal, financial, or reputational risk.
Data deletion. Following termination, all data is permanently and irreversibly deleted. We hold no obligation to retain, recover, or supply any data after termination, and no obligation to provide advance notice of deletion.
Non-payment never ends a service without warning. We send a reminder before the invoice falls due, and a further warning before suspension. A suspended service keeps its data until termination. Once termination has taken place, deletion cannot be reversed.
You may cancel any service through your client area. Cancellation takes effect at the end of the paid term. No refund arises under section 6.
9. Backups and data
You are solely responsible for maintaining your own backups. Where a backup facility is offered, it is provided as a convenience only, without warranty of any kind, and must not be relied upon as your only copy.
We accept no liability whatsoever for the loss, corruption, deletion, disclosure, or inaccessibility of any data, however caused, including where caused by our own act or omission, hardware failure, software failure, network failure, human error, or third-party action.
10. Availability
Any uptime figure published by us, including any figure described as a service level target, reflects the target of the Infrastructure Provider and is provided for information only. It is not a guarantee, does not form part of these Terms, and creates no entitlement to credit, compensation, or refund.
Services may be interrupted for scheduled maintenance, emergency maintenance, network events, hardware failure, or any act of the Infrastructure Provider. We will make reasonable efforts to give notice of scheduled maintenance but are under no obligation to do so.
11. Disclaimer of warranties
Services are supplied "as is" and "as available", with all faults. To the fullest extent permitted by applicable law, we disclaim every warranty, condition, representation, and term, whether express, implied, statutory, or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, uninterrupted availability, or freedom from error.
We do not warrant that any service will meet your requirements, operate without interruption, be secure against intrusion, or that any defect will be corrected.
12. Limitation of liability
To the fullest extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind.
- We are not liable for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of anticipated savings, loss of contract, loss of opportunity, or loss, corruption, or disclosure of data, in each case whether direct or indirect.
- We are not liable for any act, omission, failure, insolvency, or termination of service by any Infrastructure Provider, datacenter, network carrier, payment processor, or other third party.
- We are not liable for any harm arising from your own configuration, software, security practices, or content.
Aggregate cap. Our total aggregate liability arising out of or in connection with any service, under any theory of liability whatsoever, is limited to the amount actually paid by you to us for that specific service in the one (1) month immediately preceding the event giving rise to the claim.
These limitations apply even where we have been advised of the possibility of such loss and even where a limited remedy is found to have failed of its essential purpose.
13. Indemnity
You agree to indemnify, defend, and hold harmless SwiftHost, its operator, and its suppliers against all claims, demands, proceedings, losses, damages, fines, penalties, costs, and expenses (including legal fees on a full-indemnity basis) arising out of or connected with:
- your use of any service;
- any content you store, transmit, or make accessible;
- your breach of these Terms or of any applicable law;
- any claim brought by a third party in connection with your service or content.
14. Force majeure
We are not liable for any failure or delay in performance caused by any circumstance beyond our reasonable control, including war, armed conflict, civil unrest, terrorism, natural disaster, epidemic, fire, flood, strike, failure of power or telecommunications, government action, sanctions, export controls, internet or banking disruption, cyber attack, or the act or omission of any third-party supplier.
15. Changes to these Terms
We may amend these Terms at any time. The amended version takes effect when published on this page. Your continued use of any service after publication constitutes acceptance. It is your responsibility to review this page periodically.
16. Assignment
You may not assign or transfer your account, any service, or any right under these Terms without our prior written consent. We may assign or transfer our rights and obligations freely, including in connection with a sale of the business.
17. Severability and waiver
If any provision of these Terms is held invalid or unenforceable, that provision is severed to the minimum extent necessary and the remainder continues in full force. Our failure to enforce any provision is not a waiver of that provision or of any other.
18. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the services and supersede all prior communications, representations, and understandings, whether written or oral.
19. Governing law and disputes
These Terms are governed by the law applicable at the principal place of business of the service provider, without regard to conflict of law principles.
Before any formal step, both parties agree to raise the matter in writing and to attempt to settle it in good faith. Most disputes are resolved this way. Where that fails, the matter is subject to the exclusive jurisdiction of the competent courts at the service provider's principal place of business.
Before commencing any proceedings, you agree to contact us in writing and allow thirty (30) days to resolve the matter in good faith.
20. Contact
All notices, complaints, and abuse reports should be sent to support@swifthost.io. We aim to acknowledge correspondence within a reasonable period but give no guaranteed response time.
